Temporary Workers

Temporary visas may be granted to those with business interests or employment opportunities in Australia. Work visas may require a pre-arranged job or sponsorship by an Australian employer. Some temporary work visas allow an overseas employer to send an employee to work in Australia.

In some cases, a permanent visa rather than a temporary visa may be the most appropriate visa.

Temporary Working Visas are:

  • Temporary Work (Skilled) (Subclass 457) Visa
  • Temporary Work (Short Stay Activity) Visa (Subclass 400)
  • Temporary Work (Long Stay Activity) Visa (Subclass 401)

Temporary Work (Skilled) - Standard Business Sponsorship (Subclass 457)

About this Visa

The subclass 457 visa is for skilled workers from outside Australia who have been sponsored and nominated by a business to work in Australia on a temporary basis.

A business can sponsor a skilled worker if they cannot find an appropriately skilled Australian citizen or permanent resident to fill a skilled position listed in the Consolidated Sponsored Occupations List .

The stages of a subclass 457 visa

There are three stages to employing a skilled worker under the subclass 457 visa program:

  • employer applies to be a sponsor
  • employer nominates a position
  • employee applies for a visa.

Temporary Work (Short Stay Activity) visa (subclass 400)

About this Visa

The Temporary Work (Short Stay Activity) visa (subclass 400) is a temporary visa that lets you enter Australia to:

  • do short-term, highly specialised, non-ongoing work
  • participate in an event or events on a non-ongoing basis at the invitation of an Australian organisation.

You can usually stay in Australia for up to six weeks.

You must be outside Australia when you apply for this visa and when the visa is decided.

Temporary Work(Long-stay Activity) Visa(Subclass 401)

About this visa

The Temporary Work (Long Stay Activity) visa (subclass 401) is for people who want to come to Australia on a temporary basis under one of the four streams under this visa:

  • Exchange stream : to work in a skilled position under a reciprocal staff exchange arrangement to:
    • give participants an opportunity to experience another culture
    • enhance international relations
    • broaden participants experience and knowledge.
  • Sport stream: to improve the quality of sport in Australia through participation in high-level competition with Australian residents to:
    • participate in a specific event or series of events as an individual or as part of a team or its support staff
    • play, coach or instruct for an Australian sporting team or organisation under contractual arrangements
    • judge or adjudicate a sporting competition or show.
  • Religious Worker stream: to be a full-time religious worker, serving the religious objectives of a religious institution in Australia.
  • Domestic Worker (Executive) stream: to work full time in the household of certain senior foreign executives.

This is a temporary visa. You can be in or outside Australian when you apply for this visa:

  • If you apply in Australia, you must be in Australia when the visa is decided.
  • If you apply outside Australia, you must be outside Australia when your visa is decided.

Temporary Work (International Relations) (Subclass 403) Visa

The Temporary Work (International Relations) (subclass 403) visa will allow you to come to Australia on a temporary basis to:

  • undertake work or an activity in accordance with the terms and conditions of a bilateral agreement between a Commonwealth or state/territory government and a government of another country
  • represent a foreign government (where you do not have official status) or be employed as a foreign language teacher by a foreign government in an Australian school
  • undertake domestic work for the holder of a Diplomatic (Temporary) visa (subclass 995)
  • be a person to whom privileges and immunities will be accorded under the International Organisations (Privileges and Immunities) Act 1963 or the Overseas Missions (Privileges and Immunities) Act 1995.

There are four streams for the Temporary Work (International Relations) (subclass 403) visa.

Temporary Work (Entertainment) (Subclass 420) Visa

For Visa Applicants

People who want to come to Australia on a temporary basis to work in film, television or live productions in either a performance or behind-the scenes role, such as, directors, producers and other production personnel, will need to apply for the Temporary Work (Entertainment) (subclass 420) visa.
Note:

  • People intending to come to Australia for short stays (generally less than six weeks) to make a documentary or commercial that will be shown overseas (and is not intended to be shown in Australia) may be eligible for the Business (Short Stay) (Subclass 456) visa.
  • Journalists who previously used the Media and Film Staff (subclass 423) visa will not be able to use the Temporary Work (Entertainment) (subclass 420) visa. Instead they will need to apply for an appropriate work visa such as the Temporary Work (Skilled) (subclass 457) visa or a Business (Short Stay) (subclass 456) visa
